Mayor John McMenamin called the Stafford Township Council Meeting to order with the Salute to the Flag and the reading of the Open Public Meeting Statement. TIME: 7:02 PM

ORDINANCES –SECOND READING AND FINAL DISPOSITION

ORDINANCE 2009-49

ORDINANCE OF THE TOWNSHIP OF STAFFORD, COUNTY OF OCEAN, STATE OF NEW JERSEY, AMENDING AND SUPPLEMENTING CHAPTER 114 OF THE TOWNSHIP CODE OF THE TOWNSHIP OF STAFFORD ENTITLED “FLOOD HAZARD AREAS”

Mayor McMenamin opened public comment on Ordinance 2009-49 and also asked Mr. Moran for a defined explanation of the terms in the ordinance.

Stan Jeffries – 8 Magnolia Road – questioned why the need for this ordinance?

Mr. Moran explained that the primary change in this ordinance has to do with the elevation of the flood plan for structures and redefines certain areas in the township that must comply with the new FEMA regulations.

ORDINANCE 2009-50

ORDINANCE OF THE TOWNSHIP OF STAFFORD, COUNTY OF OCEAN, STATE OF NEW JERSEY, CREATING A NEW CHAPTER 105 OF THE TOWNSHIP CODE, TO BE ENTITLED “FERTILIZER APPLICATION REQUIREMENTS”

Mr. Spodofora gave the facts on this ordinance. The damaging effects on the bay, the ocean and streams and rivers that flow to them from the use of fertilizer have been known for some time, but not much has been done about it. This ordinance is designed to lessen, if not fix the problem. The pollution in our bay is a complex puzzle; numerous factors that adversely impact our bay cannot be addressed easily. Other facts of the ordinance is that the geological composition of the soils in Stafford Township consists primarily of sandy soil that has little ability to remove nitrates, phosphates nutrients and other common ingredients found in fertilizers. Common fertilizers, which are readily available in retail stores, are regularly applied on residential and commercial properties throughout Stafford Township by property owners and landscapers, but there are no federal, state, county or local laws that regulate or restrict the application of such fertilizers. All potable water in Stafford Township comes from wells and thus depends on clean, uncontaminated groundwater, and Stafford Township, as well as communities surrounding Stafford Township.

Mr. Spodofora added that it is not the intent of the ordinance is not to be overly restrictive regarding the application of fertilizers. If the township passes this ordinance, Stafford will be the first in the State to pass any ordinance that controls the application of fertilizers.

Mayor McMenamin added that it’s an honor to be part of the ground-breaking legislation and it is a great step for the township.

COUNCIL REPORTS

John Spodofora
He will be setting up a meeting with the officers from Warren Grove Range and Mr. Moran will be setting up the meeting with the council. The officers will be invited to attend a council meeting to give a brief presentation about the range and will answer any questions that the council or the public may have.

April 23, 2010 will be the annual Arbor Day in Stafford Township. The theme of the Arbor Day celebration will be called “FROG”. Forest Recharging Our Groundwater. It will be held at All Saints Regional Catholic School at 3:30 PM. There will be more information forthcoming as the plans develop.

The fire company also wanted Mr. Spodofora to remind everyone that with the cold weather coming and with the homes closed with little or no ventilation to make sure that smoke detectors have the batteries changed and in working order to prevent any type of fires.

On November 7th, Mr. Spodofora worked with a group called Ocean County Water Watch which comprises of students and volunteers and they did a clean-up on the bridge to nowhere. Area hunters witnessed the volunteer cleanup and decided to join in their efforts.

Mr. Spodofora concluded his report by thanking the Council for their support with the fertilizer ordinance.

Joanne Sitek
Reported that there are two trips to New York which are on 12/13 and 12/18. These trips cost $28.00 and leaves from the Mill Creek Community Center. For more information, please contact the Recreation Department.

On Friday, December 4th will be Stafford’s annual Christmas Tree Lighting. The festivities will begin at 6:00 PM at town hall. On Saturday, December 5th there will be a Santa Workshop and many activities going on at the municipal building. For more information, please contact the Recreation Department.

The annual toy drive is being chaired by Rita Parker. Toys and monetary donations will be gladly appreciated. For more information, please call Rita Parker, 597-1000, ext. 8312.

Ms. Sitek stated that she and a few other council members attended the League of Municipalities. They attended budget meeting and also a meeting on revitalization of towns and found it to be very rewarding.

Steve Fessler
Mr. Fessler said that the township is fast approaching the 2010 budget. At this time he questioned the Administrator on how this budget is being worked out. Mr. Moran answered Mr. Fessler that that he is reviewing each department’s needs with the Chief Financial Officer. They will compile the information and then give a presentation to the council. He is hoping to introduce the budget by February 10th. Mr. Fessler then questioned the Mayor if the township will continue to find more shared services? Mr. Moran expressed his feelings on shared services. As always the township is always looking for ways to cut expenses.

Stan Rutkowski
Went over the new recycling procedures and Public Works have the new cans and new trucks. The township is ready for single stream recycling. Also the Public Works Department is prepared for any snow storms that may happen.

MAYOR’S COMMENTS

Mayor McMenamin thanked Rita Parker for the wonderful job that she is doing with the annual toy drive. He remarked that the Council meeting room will soon be filled with donated toys. He also stated that the Administrator has addressed some town issues and problems over these past several months by involving in house staff to perform various tasks, such as roofing repairs and drainage problems, thus significant savings.

He reminded everyone about the Christmas Tree Lighting on Friday evening, December 5th.

ADMINISTRATOR’S REPORT

Mr. Moran reported that he did receive the COAH level #2 certification and Stafford is well ahead with the affordable housing and low income.

Mr. Moran stated that Phase IV water project is closing out. Three wells in Ocean Acres are currently being upgraded. CDBG for Stafford is up for the year 2010. He will attend to represent Stafford Township.

PUBLIC COMMENT

Mayor McMenamin opened public comment

Joe Mazzola, 1211 Galley Avenue: requested an explanation of Resolution 2009-313 regarding the 966 Fund. Mr. Moran replied that this is the Emergency Management funding money that provides and is distributed to towns surrounding nuclear power plants. This resolution is to plead to restore this money that the township receives for the Emergency Management. The amount has been decreased from $700,000. to slightly more than $200,000. Mr. Mazzola questioned the shared services for water for emergencies only. Mr. Moran said that the township is not sharing services with Barnegat for water. There are four valves that are closed and are for emergency use only. Mr. Mazzola also inquired as to how are the union contracts negotiations going? Mr. Moran stated that they are still in discussion. Mr. Mazzola also asked Mr. Rutkowski about the collection of leaves. Mr. Rutkowski replied that the Public Works Department is behind. Mr. Mazzola said that the leaves are supposed to be picked up in November and December and then not until April. Mr. Moran responded that due to the bad weather of constant rain is why the Public Works Dept. is behind. He will call to see what the problem is.

Nancy Saldon, Executive Director of the NJ Green Industry Council: gave a statement that she is very active and has sat on task forces and is concerned about not seeking expertise from various areas such as Rutgers. She questioned the ordinance. Ms. Saldon said that bills are in the working and asked the council to please take time and share expertise with one another. Ms. Saldon stated that she doesn’t want to see anyone rush into anything. If this is going to be a model ordinance and should be based on science. Mr. Spodofora stated that he would disagree with Ms. Saldon. He said that a lot of time and research has gone into making this ordinance. He did apologize to Ms. Saldon for not involving NJ Green Industry Council. Stafford Township feels that this Ordinance will educate everyone on the use of fertilizer. Ms. Saldon wants to be more actively involved with this ordinance.

Elaine Williams, 1203 Jennifer Lane: who resides across street from the Jennifer Bay Beach asked what will be done in regard to the orange fencing. The township engineer feels as though the township can address some problems. There are also DEP issues and also money problems. Ms. Williams said that the beach is an embarrassment. Mr. Moran stated that cosmetics will be addressed before the summer.

Michael Mattalian, 164 Topside Road: stated that the public water hookup has and is a hardship for him. He is on a fixed income and is very difficult for him. He also said that the contractor is doing a terrible job in regard to the installation of the water lines. Mr. Moran replied that the township is working with the engineer to correct the problems and he also understands the hardship that many residents are having with the water hookup expense.

Dr. Stan Hales, member of the Barnegat Bay Estuary Program: stated that the Barnegat Bay Estuary Program does offer services to Stafford Township regarding the fertilizer ordinance. He also commended Stafford Township to be the first municipality to introduce an ordinance of this kind.

Dolores Freeswick, 77 Benjamin Blvd: stated that she has called the township three times, sent letters and pictures regarding the stone wall near the fire hydrant that has not yet been repaired. Mr. Moran explained that the township is trying to get repairs and problems resolved. There is a performance bond involved and the township is attempting to issue after the repairs have been completed.

Alison Aaron, Ship Bottom: attorney in Stafford Township and a member of the Bay Ave. Business Association. She informed the governing body and the audience that on December 5th, the Bay Avenue Business Association is inviting everyone to Discover Bay Avenue of Manahawkin for the Holidays on Saturday, December 5th from 11:00 AM until 4:00 PM. There will be refreshments, raffles, prizes, crafts for the children, and pictures with Santa, at participating businesses. This event is being presented in conjunction with The Stafford Township Department of Recreation. She also urged everyone to get to know the various businesses in Stafford. She has educated herself and addresses environmental issues. She concluded by stating that she commends Stafford and their amazing step forward as inspirational.

Thomas Gimble, 112 Barracuda Rd: stated that he is a member of the Environmental Commission and is in favor of the fertilizer ordinance being introduced. Mr. Gimble did ask Mayor McMenamin about the lawsuit regarding Chief Conroy? Mr. Starkey the township attorney replied that it is still pending and will be heard on December 15th. Mr. Gimble asked what is the estimate so far on the lawsuit. Mr. Starkey replied to Mr. Gimble that he does not have an estimate as of yet. Mr. Gimble asked if there was any decision regarding the Emergency Management Coordinator? Mr. Starkey replied that a decision has not yet been determined. Mr. Gimble asked the council not to hire Mr. Moran. Mayor McMenamin replied to Mr. Gimble that Mr. Moran has done a great job.

Steve Jeffries, 8 Magnolia Road: commented that the fertilizer ordinance that was introduced is reducing his freedom on how to take care of his lawn, the cost to the town and to the residents. Mr. Spodofora stated that the township is not reducing his freedom, the township is just following recommendations from the manufacture’s guidelines, and most people when educated on the use of fertilizer will comply. Mr. Jeffries asked to take the enforcement out of the ordinance.

Sharon McKenna, 314 Privateer Road: is very happy that Bonnie Flynn has been appointed as the alternate CDBG representative. Ms. McKenna said that Barnegat Bay is very important to her. She has been working for Barnegat Bay for around 20 years and she feels that this fertilizer ordinance is very important to be enacted upon. She is very happy that the township is going down this path. Lastly Ms. McKenna stated that she attended a meeting with Dr. Hales from the Barnegat Bay Estuary Program at Monmouth University regarding MARCO which stands for Mid-Atlantic Regional Ocean Council which consists of 5 different states that are working together regarding ocean issues. One of the main issues is water quality and this fertilizer ordinance came up and once again she was very proud of Stafford that has a model ordinance. Once again the township has the storm water ordinance which is a model ordinance for the state and this fertilizer ordinance which is a model ordinance for the State. She is very proud to be a resident of Stafford Township. She thanked the governing body for their hard work and certainly appreciates it.

Larry Parker, 510 Doc Cramer Blvd: thanked the council for introducing the fertilizer ordinance. Chief Parker did have some reservation about Jim Moran and now he totally impressed with the knowledge he has running the township. He has earned his admiration and Mr. Moran has compassion and every organization needs a good leader. He commended the Mayor and Council for their choice of Mr. Moran. Chief Parker advised the council that Norm Steadman a retired sergeant from the Stafford Township Police Department is in critical condition at SOCH. He asked for everyone’s thoughts and prayers for Sergeant Steadman. He concluded his comments stating that his own son has not been well and thanks everyone for their concern.

Paul Krier, 257 Stormy Road: addressed Mr. Moran regarding the fertilizer ordinance. Sometimes ordinances are hard to understand. He asked what can a normal individual address the application and guidelines? Mr. Moran stated that there will be a fact sheet and classes will be given.

Mayor McMenamin seeing no further comment from the audience closed the public comment portion of the meeting.

Motion to adjourn the meeting was made by Mr. Fessler, seconded by Mr. Spodofora. RCV: All in favor – aye.
