Mayor John McMenamin called the Stafford Township Council Meeting to order with the Salute to the Flag and the reading of the Open Public Meeting Statement. TIME: 7:05 PM

RESOLUTION 2009-339

RESOLUTION OF THE TOWNSHIP OF STAFFORD, COUNTY OF OCEAN, STATE OF NEW JERSEY, AUTHORIZING THE CONVENING OF AN EXECUTIVE SESSION IN ACCORDANCE WITH THE OPEN PUBLIC MEETINGS ACT

ORDINANCES – SECOND READING & FINAL DISPOSITION

ORDINANCE 2009-50

ORDINANCE OF THE TOWNSHIP OF STAFFORD, COUNTY OF OCEAN, STATE OF NEW JERSEY, CREATING A NEW CHAPTER 105 OF THE TOWNSHIP CODE TO BE ENTITLED “FERTILIZER APPLICATION REQUIREMENTS”

Mayor McMenamin opened public comment on Ordinance 2009-50.

Steve Jeffries, 89 Magnolia , this ordinance is a sham. Government intrusions cannot prove that this ordinance will stop pollutants entering the bay. Business costs will be passed on to consumers. Why does Stafford have to be first? Zero impact on the bay. Citizens are being intruded. This ordinance is a perfect example of government overstepping its boundaries.

Mr. Spodofora replied to Mr. Jeffries saying that this ordinance does not limit an individual on applying fertilizer. This is a fertilizer application ordinance. This ordinance governs the proper methods of applying fertilizer, when to fertilize and when not to fertilize. The ordinance is very well structured and is a very common sense ordinance.

Dr. Mike Kennish, a research professor with the Institute of Marine and Coastal Sciences at Rutgers University, said 29.3 percent of all nitrogen in the bay comes from fertilizers. Nitrogen compounds carried to the bay in runoff can fuel algae growth. Dr. Kennish said that John Spodofora should be commended for his work on this.

Steve Kennedy, owner of Natural Outdoor Environment stated that this ordinance is a little premature. He is already paying State fees and insurance for his license. Takes exemption and the classes only address lawn care and landscapers. Homeowners can create problems. He said to educate the public on phosphorus restriction.

Mr. Spodofora said to just present to the township the turf survey plan. The township is trying to work to educate public. There is a campaign to educate the public on the use of fertilizer. Mr. Kennedy asked Mr. Spodofora who will enforce this ordinance? Mr. Spodofora replied that Code Enforcement.

Nancy Sadlon, Executive Director of the New Jersey Green Industry Council, thanked council for listening by bringing in communication between groups. She said she would like to keep talks on the ordinance open. She is asking the governing body to hold on passing this ordinance until all comments and recommendations are submitted. Strongly listen from the experts. She said that she would like to see more science brought to the process. Ms. Sadlon also stated that she is all for education, but there are things that she would like to see changed. She is very concerned about the 25 foot buffer. The attorney responded changed wording. Ms. Sadlon stated that the professionals want to share their expertise and to please keep talks open.

Willie Decamp from Save Barnegat Bay, supports Stafford’s ordinance. He is here to thank Mr. Spodofora and would also like to address nitrogen—problem is that it is fast acting. Water soluble nitrogen is bad for the bay. Problem is that only some people actually read the directions in applying fertilizer. Would like to be a part for the input in Ordinance.

Greg Meyer, 933 Middie Lane, is concerned about the fees. He feels that this ordinance is really having the impact that the governing body is looking for. He agrees that it is common sense to read the directions. He also said that the township will be an example for other towns but will the township also comply with this ordinance? He said to start with the municipal properties. How is a $20 fee going to change? Mr. Spodofora said that this fee is to cover the teaching costs.

Kelly Quinlan, from Long Beach Island, would like to see amendments regarding nitrogen. Would like to be involved in future changes to this Ordinance. Local economy depends on the Bay and the pollution runoff destroys the clams, fish, etc. Ms. Quinlan is in favor of this ordinance.

Ms. Jackson, who is the conservation chair of Ocean County, and is here to support this ordinance. She is a resident of the area and has lived here over 50 years and has seen changes in Barnegat Bay area. Something needs to be done. The over flow of nitrogen and phosphates do harm the bay and fish living in the bay.

Ernest Boerner, 41 Aspen Lane, has lived in the area for years and is in favor of this ordinance being passed. Fertilizers have been a problem throughout the years. Mr. Boerner praised Mr. Spodofora for his efforts in establishing this ordinance. His wife, former councilwoman Mrs. Boerner is also in favor of this ordinance.

Paul Krier, Stormy Road, asked if the township has seen any increases in nitrates in groundwater at all? A gentlemen from the audience replied to Mr. Krier saying 60 fold increase. Mr. Krier asked how does one differentiate between the different levels of nitrogen? Dr. Kennish answered Mr. Krier, however his answer was not audible. Mr. Krier asked why hasn’t the State of NJ DEP and the Environmental Commission address this ordinance? He finds a conflict with it. Mr. Krier also feels that it should not be addressed as a township ordinance. He also said that the State should be involved and it shouldn’t be the role of the township.

Sharon McKenna, 314 Privateer Rd., would like to commend the Council for this ordinance. She had recently testified regarding cooling towers and Stafford Township was mentioned.

Larry Garrison, of Toms River, is here because of curiosity regarding the fertilizer ordinance and is interested in the local political process. Is in favor and supports this ordinance.

Dr. Stan Hales, Director of the Barnegat Bay National Estuary Program, stated that this program actually works for everyone regarding the bay. Dr. Hales said that this is a difficult issue and many of the bay’s issues are difficult. He is impressed with the support of this ordinance and more rules will be forthcoming. Other states are getting involved learning about fertilizers and correct application processes.

Councilman Stan Rutkowski commented that he grew up in north Jersey on the North Bay. People don’t fish or clam there because of the pollution there. Mr. Rutkowski said that if there was a John Spodofora there back in the fifties, there would be clamming and fishing there. He is much honored to be a part of this.

ORDINANCE 2009-51

ORDINANCE OF THE TOWNSHIP OF STAFFORD, COUNTY OF OCEAN, STATE OF NEW JERSEY, AMENDING CHAPTER 178 OF THE TOWNSHIP CODE ENTITLED “SOIL DISTURBANCE”

Mayor McMenamin opened public comment on Ordinance 2009-51.

Sal Sorce, 31 Poplar Street, stated that several months ago, the Walters Group sold soil that was excavated from the landfill region that was used to replenish the beach in Harvey Cedars. When Mr. Sorce contacted the DEP and they were not aware of any permitting in removing the soil. Further investigation shows that no land soil can be used for beach replenish. Mr. Sorce asked if this ordinance has anything to do with this? Mr. Starkey, the township attorney, replied to Mr. Sorce that this ordinance has nothing do with the beach replenish. Mr. Starkey replied that it is a minor revision to the soil disturbance ordinance. Mr. Moran added that this amending act control to do with being the Ocean County Soil Conservation District Code. Nothing more, nothing less. The Ocean County Soil Conservation has amended their code and now Stafford is amending their code.

ORDINANCE 2009-52

ORDINANCE OF THE TOWNSHIP OF STAFFORD, COUNTY OF OCEAN, STATE OF NEW JERSEY, AMENDING AND SUPPLEMENTING CHAPTER 47 OF THE TOWNSHIP CODE OF THE TOWNSHIP OF STAFFORD ENTITLED “WATER AND SEWER UTILITY” SO AS TO AMEND THE WATER AND SEWER CAPITAL SURCHARGE

Mayor McMenamin asked Mr. Moran to give the public a brief explanation of this ordinance. Mr. Moran stated that the township was going to do everything in his power to reduce the water and sewer capital surcharge for 2010. Mr. Moran said that the township was able to reduce the surcharge for the year 2010. The residential rate was reduced by $5.00, which does not seem like a whole lot. The township has already reduced the commercial rate by a substantial amount. The commercial rates in the $200,000 and $400,000 of the smaller businesses that have exceeded the $200,000 amount, will now have their rate cut in half from the $200,000.

Mayor McMenamin opened public comment on Ordinance 2009-52.

Donna Palmarrazzo, owner of Scissor Sisters, said that the paper she has states a different rate. She would like a clarification. Mr. Moran went over the explanation of the commercial water and sewer capital surcharge. Ms. Palmarrazzo asked Mr. Moran why does the commercial businesses have to take the brunt of it and how did you calculate these surcharges? Mr. Moran explained the process of the calculation and how the numbers were derived.

There being no further comment on Ordinance 2009-52, Mayor McMenamin closed public comment on Ordinance 2009-52.

ORDINANCES – INTRODUCTION & FIRST READING

THE FOLLOWING ORDINANCE IS SCHEDULED FOR PUBLIC COMMENT AND ADOPTION AT THE SPECIAL MEETING OF THE MAYOR AND COUNCIL TO BE HELD ON DECEMBER 28, 2009 AT 8:30 AM

ORDINANCE 2009-53

ORDINANCE OF THE TOWNSHIP OF STAFFORD, COUNTY OF OCEAN, STATE OF NEW JERSEY, AMENDING ORDINANCE 2008-11 ENTITLED “FIXING AND DETERMINING SALARIES AND WAGES OF CERTAIN EMPLOYEES AND OFFICIALS OF THE TOWNSHIP OF STAFFORD, COUNTY OF OCEAN, STATE OF NEW JERSEY” TO PROVIDE FOR THE POSITION OF EMERGENCY MANAGEMENT COORDINATOR FOR 2008

Motion to reject Ordinance 2009-53 was made by Mr. Spodofora, seconded by Mr. Kusznikow. RCV: Corbett, no, Kusznikow, yes, Rutkowski, no, Sitek, no, Spodofora, yes, McMenamin, no.

Mr. Spodofora commented that he would like to address some issues regarding the introduction of this ordinance. He feels that with this motion on the table is not being fair. He has some very serious concerns with this ordinance. He said that he has financial issues and costs analysis regarding this ordinance. Mr. Spodofora said that he was promised that all these things would be resolved prior to the vote coming up and they have not been resolved. He is asking the Mayor to postpone this ordinance until all the information that the council needs to resolve the issues that are outstanding including the cost analysis and financial reasonable approach to this problem.

Mayor McMenamin replied that this is the fourth meeting of putting this ordinance on the agenda. Mayor McMenamin also stated that in the long run, by making the emergency management coordinator a paid position it will save the township money. In the past, the position was unpaid and filled by a member of the police department. This is the most important position in the township. The Emergency Management Coordinator is in charge of the emergency preparedness with outside agencies and the general public.

Ms. Sitek stated that she is in favor of this ordinance and when Lieutenant Giberson attended one of the prior meetings he stated that he is in favor of this ordinance and that is what swayed Ms. Sitek’s vote for it.

COUNCIL REPORTS

John Spodofora
Mr. Spodofora went over the November Stafford Township Volunteer Fire Company Report. He also wished everyone a Happy Holiday season.

Robert Kusznikow
Mr. Kusznikow and his family wished everyone a very Happy Holiday and a Happy New Year.

Stanley Rutkowski
On behalf of himself and his family, wished everyone a Happy Holiday Season.

Joanne Sitek
Ms. Sitek commended the Recreation Department on their excellent job with the Christmas Tree Lighting and also the events that were held the day after the Christmas Tree Lighting. She also extended her wishes to everyone for a very Happy Holiday Season.

ADMINISTRATOR’S REPORT

Mr. Moran advised the governing body that Forte Builders’ has allowed the township to go after the bonds. There have been major problems and the township is trying to address all of the resident’s problems.

MAYOR’S REPORT

Mayor McMenamin commented that even with the holiday season and even with disagreements between council members, they all are working together to provide in the best interest of Stafford Township. He also wished everyone and their families a very Happy Holiday Season and a Healthy and Happy New Year.

PUBLIC COMMENT

Mayor McMenamin opened public comment.

Sal Sorce, 31 Poplar Street, as a friend of the environment, I promised Willie DeCamp and others that he would speak out to the community regarding the Cooling Tower at the Oyster Creek plant. Mr. Sorce read the following points: The plant is in the Legislature District of Christopher Connors, it is imperative that the governing body support this bill. Mr. Sorce also went over the financial status of the Oyster Creek Nuclear Plant located in Lacey Township. Mr. Sorce is asking what the council’s stand is on this? He believes that the council’s heart is in the right place, but this fertilizer ordinance is coming too late. Mr. Sorce thanked Mr. Spodofora for his dedication in this fertilizer ordinance.

Joe Mazzalo, Galley Ave., thanked Stan Rutkowski for his true to word regarding the leaves being removed. Mr. Mazzalo also congratulated Jim Moran on his contract. He asked about the 3.5% increase over the next three years. He and other seniors are asking why the administrator is getting a 3.5% increase every year, whereas the seniors can’t even get a nickel raise. Mayor McMenamin answered Mr. Mazzalo stating that with all the other contracts that were settled, that the employees would not get anything for 2009 but would get a 3.0% raise in 2010, etc. Mr. Mazzalo then inquired about water on his street due to a pool that was emptied and causing water collecting. Mr. Moran will have Public Works look into it.

Steve Miller, Serpent Lane, publicly acknowledged his neighbor who returned safely from Afghanistan. Mr. Miller then asked Mayor McMenamin why there was no attendance by Stafford for the meeting that Governor-elect Chris Christie held for the Ocean County Mayors? Mayor McMenamin answered saying that the meeting was by invitation only. Many of the Mayors did not get an invitation to attend and Mayor McMenamin was one of them. Mr. Miller asked why he did not get one and Mayor McMenamin replied that he did not know.

Paul Krier, Stormy Road, stated that he is not in favor of this ordinance creating the Emergency Management Coordinator. Also Mr. Krier doesn’t understand why the public hearing of this ordinance will be at the meeting of 12/28/09 at 8:30 am. What is the huge reason for this rush? The public cannot readily make an 8:30 am meeting. Mr. Moran explained that there is other business that needs to be taken care of before the end of 2009 and in order to accomplish this there has to be a meeting where a quorum will be available to enact upon this legislation.

Steve Jeffries, Magnolia, also commented about the public comment date and can’t understand why it has to be so early in the morning.

Joan Williams, 200 Timberlake Dr., is against paying for the Emergency Management Coordinator and is also against hiring a Deputy Chief.

There being no further comment from the public, Mayor McMenamin closed the public comment portion of the meeting.

Motion to adjourn the December 15, 2009 was made by Ms. Sitek, seconded by Mayor McMenamin. RCV: All in favor – aye. Fessler absent.
